Background: Family members are often required to act as substitute decision-makers when health care or research participation decisions must be made for an incapacitated relative. Yet most families are unable to accurately predict older adult preferences regarding future health care and willingness to engage in research studies. Discussion and documentation of preferences could improve proxies' abilities to decide for their loved ones. This trial assesses the efficacy of an advance planning intervention in improving the accuracy of substitute decision-making and increasing (...) the frequency of documented preferences for health care and research. It also investigates the financial impact on the healthcare system of improving substitute decision-making. Methods/DesignDyads (n = 240) comprising an older adult and his/her self-selected proxy are randomly allocated to the experimental or control group, after stratification for type of designated proxy and self-report of prior documentation of healthcare preferences. At baseline, clinical and research vignettes are used to elicit older adult preferences and assess the ability of their proxy to predict those preferences. Responses are elicited under four health states, ranging from the subject's current health state to severe dementia. For each state, we estimated the public costs of the healthcare services that would typically be provided to a patient under these scenarios. Experimental dyads are visited at home, twice, by a specially trained facilitator who communicates the dyad-specific results of the concordance assessment, helps older adults convey their wishes to their proxies, and offers assistance in completing a guide entitled My Preferences that we designed specifically for that purpose. In between these meetings, experimental dyads attend a group information session about My Preferences. Control dyads attend three monthly workshops aimed at promoting healthy behaviors. Concordance assessments are repeated at the end of the intervention and 6 months later to assess improvement in predictive accuracy and cost savings, if any. Copies of completed guides are made at the time of these assessments. DiscussionThis study will determine whether the tested intervention guides proxies in making decisions that concur with those of older adults, motivates the latter to record their wishes in writing, and yields savings for the healthcare system. The Masters of Truth in Archaic Greece traces the odyssey of "truth," Aletheia, from mythoreligious to philosophical thought in archaic Greece. Marcel Detienne's starting point is a simple observation: In archaic Greece, three figures - the diviner, the bard, and the king - all share the privilege of dispensing truth by virtue of the religious power of divine memory which provides them with knowledge, both oracular and inspired, of the present, past, and future. Beginning with this definition of the (...) prerational meaning of truth, Detienne proceeds to elaborate the complex conceptual and historical contexts from which emerges the philosophical notion of truth still influencing Western philosophy today. Preventive medicine is sometimes criticised as it contributes to medicalization of normal life. The concept ‘medicalization’ has been introduced by Zola to refer to processes in which the labels ‘healthy’ and ‘ill’ are made relevant for more and more aspects of human life. If preventive medicine contributes to medicalization, would that be morally problematic? My thesis is that such a contribution is indeed morally problematic. The concept is sometimes used to express moral intuitions regarding the practice of prevention and health (...) promotion. Through analysis of these intuitions as well as some other moral concerns, I give an explication of the moral problems of medicalization within the context of preventive medicine. (shrink)

ABSTRACT If we have a duty not to infect others, how far does it go? This question is often discussed with respect to HIV transmission, but reflection on other diseases like influenza raises a number of interesting theoretical issues. I argue that a duty to avoid infection not only yields requirements for persons who know they carry a disease, but also for persons who know they are at increased risk, and even for those who definitely know they are completely healthy. (...) Given the numerous ways in which human interaction facilitates the spread of communicable diseases, a maximum level of precaution would be very demanding – possibly unreasonably demanding. The ‘over‐demandingness problem’ is mostly invoked as a criticism of utilitarianism, as this theory requires moral agents to always maximise general welfare, even at significant cost for themselves. However, I argue that, with respect to precautions against infectious diseases like influenza, utilitarianism is able to avoid the over‐demandingness problem. A contractualist account, on the other hand, whilst able to explain how one's obligations to avoid infection can be limited, given that other persons have opportunities and responsibilities to protect themselves, in the end requires precautions that raise the over‐demandingness problem. The European Corporate Sustainability Framework (ECSF) is, among other concepts, based on a phase-wise development approach as described by Clare Graves' Levels of Existence Theory. As much as corporate sustainability has a sequence of adequate interpretations, aligned with each development level, also the notion of business excellence can be defined at multiple levels, as this paper demonstrates. Furthermore, the authors analyze the current EFQM Excellence Model for particular biases towards various development levels and suggest a new and innovative two-step approach (...) to assessing organizational performance with respect to organizational excellence (OE) and corporate sustainability. According to the organization's ambition, the assessment is either limited to a shareholder approach, mainly focusing at optimal usage of resources, or it also includes an additional assessment format based on the stakeholder approach, with specific reference to the organization's performance on the financial, social and ecological bottom line. This paper demonstrates the need and feasibility of an EFQM-Based assessment tool with a combined focus on corporate sustainability and OE. (shrink)

In this essay I explore the role of dialectics for how social theory can take account of the problem of structure and agency, or, determination and freedom, in a critical and emancipatory way. I discuss the limits and possibilities of dialectical, and of anti-dialectical, criticisms of Hegelian dialectics. For this purpose, I look at Judith Butler’s discussion of dialectics and the concepts of ‘sex’ and ‘gender’ in her writings between 1987 ( Subjects of Desire ; republished 1999) and 1990 ( (...) Gender Trouble , republished 2000). Butler’s book Gender Trouble remains a key text of contemporary feminist theory. Butler formulates in this book a critique of Simone de Beauvoir’s The Second Sex based on her claim that Beauvoir makes a distinction between ‘sex’ and ‘gender’ that implies the notion of the sexed body as a pre-cultural entity. In her earlier writings, though, her evaluation of de Beauvoir had been much more positive. The change in Butler’s evaluation of de Beauvoir is part of her increasing rejection of dialectics: Butler rejected in Gender Trouble any form of Hegelian dialectics with reference to Luce Irigaray’s (1985) claim that it is ‘phallogocentric’. Although Butler subsequently returned to Hegelian themes, she seems never to have revoked this claim made in her most momentous work. I argue that this change in the theoretical structure of Butler’s argument weakens her critique of identity politics and I suggest reading Butler backwards, from Gender Trouble to the more open discussion of dialectics in her earlier texts. Drawing on Adorno’s Negative Dialectics and other formulations of critical theory, I argue that the valid aspects of the critique of Hegelian dialectics can better be formulated as a dialectical critique of dialectics (Adorno; Butler, 1987a) than as a rejection of dialectics (Derrida; Irigaray; Butler, 1990). Retracing the genealogy of Butler’s argument will be a necessary backdrop, too, for evaluating her more recent comments on the Hegelian and ‘Frankfurt School’ traditions such as her Adorno Lectures given in Frankfurt am Main, Germany, in November 2002. One of the societal problems in a new influenza pandemic will be how to use the scarce medical resources that are available for prevention and treatment, and what medical, epidemiological and ethical justifications can be given for the choices that have to be made. Many things may become scarce: personal protective equipment, antiviral drugs, hospital beds, mechanical ventilation, vaccination, etc. In this paper I discuss two general ethical principles for priority setting (utility and equity) and explain how these principles will (...) often point in diverging directions. Moreover, each of these principles can be understood in different, again often competing, ways. Notwithstanding these controversies and conflicts, in the context of pandemic response there are at least some points of convergence: several policies can be justified by appeal to different ethical principles and theories. Convergence may be found with respect to a focus on saving the most lives (instead of other aggregative accounts); giving priority antiviral prophylaxis and therapy for life-saving pandemic responders; and, partly depending on epidemiology of the pandemic, to prioritise vaccination of children. Although decision-making about access to intensive care will involve choices with immediate tragic implications, the ethical complexity of these choices is relatively modest (although decisions will not be easy): there are persuasive moral reasons for giving priority to patients who are expected to benefit most within the shortest time. Finally, in the last section I tentatively argue that constraints on people’s freedom, as necessary for an effective public health approach, may support giving somewhat more weight to saving the most lives, than to concerns of equity. Ce travail s’interroge sur les raisons de ce qui a fait le succès de la sociologie de Georges Gurvitch de 1945 à sa mort , et entend se démarquer d’une explication qui se contente de faire valoir le rôle institutionnel actif qu’eut Gurvitch dans ce qu’on a coutume d’appeler la « refondation » de la sociologie française après 1945. En effet, un examen du contenu de ses textes suggère que son projet intellectuel était en phase avec les préoccupations de nombre (...) de sociologues à ce moment-là, certes soucieux de construire une sociologie plus empirique inspirée du modèle américain, mais aussi de conserver une ambition théorique susceptible de fournir des concepts opérationnels pour traiter les grandes questions sociales. Ainsi Gurvitch a proposé un paradigme alternatif qui, tout en illustrant une volonté certaine de « reconstruire » la sociologie, a défendu l’idée d’une continuité de la tradition sociologique en France. Il semble que sa réception a été plus favorable que ce que les textes consacrés à la question laissent entendre.This paper considers the reasons for the success of the sociology of Georges Gurvitch from 1945 until his death in 1965. The approach proposed here intends to differentiate itself from the widespread explanation that focuses essentially on the active institutional role that Gurvitch played in the rebuilding of French sociology after 1945. An examination of the contents of his texts suggests that, at that time, the focus of Gurvitch’s interests were in line with the preoccupations of other sociologists who were certainly anxious to construct a more empirical sociology inspired by the American model, but also to conserve a theoretical ambition capable of providing the operational concepts to address the significant social questions. So Gurvitch proposed an alternative paradigm, while proclaiming his desire to « rebuild » sociology, also defended the idea of a certain continuation of the sociological tradition in France. It seems that its reception was much more favourable than we are led to believe by current texts that consider the question today. (shrink)

Balancing the pros and cons of two options is undoubtedly a very appealing decision procedure, but one that has received scarce scientific attention so far, either formally or empirically. We describe a formal framework for pros and cons decisions, where the arguments under consideration can be of varying importance, but whose importance cannot be precisely quantified. We then define eight heuristics for balancing these pros and cons, and compare the predictions of these to the choices made by 62 human participants (...) on a selection of 33 situations. The Levelwise Tallying heuristic clearly emerges as a winner in this competition. Further refinements of this heuristic are considered in the discussion, as well as its relation to Take the Best and Cumulative Prospect Theory. (shrink)

There has been increased interest in the potential of maternal immunisation to protect maternal, fetal, and infant health. Maternal tetanus vaccination is part of routine antenatal care and immunisation campaigns in many countries, and it has played an important part in the reduction of maternal and neonatal tetanus. Additional vaccines that have been recommended for routine maternal immunisation include those for influenza and pertussis, and other vaccines are being developed. Maternal immunisation is controversial since regulators, professionals, and the public are (...) often reluctant to accept pharmaceutical interventions during pregnancy. So far, little attention has been given to the ethics of vaccination during pregnancy. In this Personal View we argue that maternal immunisation should be offered in response to concrete, severe risks of disease for mother and child, and we explain how this requirement of serious risk can be used to guide ethical decision-making about maternal immunisation. The rule of rescue holds that special weight should be given to protecting the lives of assignable individuals in need, implying that less weight is given to considerations of cost-effectiveness. This is sometimes invoked as an argument for funding or reimbursing life-saving treatment in public healthcare even if the costs of such treatment are extreme. At first sight one might assume that an individualist approach to ethics—such as Scanlon’s contractualism—would offer a promising route to justification of the rule of rescue. (...) In this chapter I argue that contractualism cannot endorse the rule of rescue, whereas a collectivist approach that appeals to group solidarity would offer support for rescue cases. The argument, however, has its limitations, and though solidarity is of central concern in shaping public healthcare, there are good reasons for not endorsing the rule of rescue as a moral basis for allocating scarce resources in clinical care. When observing or measuring phenomena, errors are inevitable, one can only aspire to reduce these errors as much as possible. An obvious strategy to achieve this reduction is by using more precise instruments. Another strategy was to develop a theory of these errors that could indicate how to take them into account. One of the greatest achievements of statistics in the beginning of the 19th century was such a theory of error. This theory told the practitioners that the best thing (...) they could do is taking the arithmetical mean of their observations. This average would give them the most accurate estimate of the value they were searching for. Soon after its invention, this method made a triumphal march across various sciences. However, not in all sciences one stood waving aside. This method, namely, only worked well when the various observations were made under similar circumstances and when there were very many of them. And this was not the case for e.g. meteorology and actuarial science, the two sciences discussed in this paper. (shrink)
